Terms of Service: Text

These terms of service will apply to anyone booking training sessions, packages or contacting Fitscape Ltd (FL) through the website, email or by phone and will constitute acceptance of these terms and conditions.

In these terms and conditions, the term ‘the trainer’ is a trainer employed by Fitscape and ‘the client’ is anyone being trained or using FL’s services.

FL’s responsibilities to the client


All information the client provides will be kept in confidence. The client’s personal details and medical information will not be made available to third parties unless permission to do so is granted by the client.

2. Recommendations

Whilst using judgement and experience, the trainer will suggest certain exercises and other lifestyle advice that the trainer believes will help the client achieve personal goals, but if at any time the client has specific requests please make the trainer aware so they can be accommodated.

3. Referral

The trainer intends to work with the client within the scope of the trainer’s knowledge and competencies as a REPs Registered Exercise Professional. Therefore, if the trainer believes it is in the client’s best interest to see another health professional, the client will be referred appropriately.

4. If the trainer cancels or runs late

Unforeseen circumstances may arise which require sessions to be rescheduled. In this event the following policy will apply:

  • If the trainer is forced to cancel session(s) within 24 hours, the trainer will make up the session at no charge to the client.

  • If the trainer is forced to cancel session(s) giving the client more than 24 hours’ notice the trainer will reschedule as soon as possible.

  • If the trainer runs late in starting session(s), the trainer will extend the session time accordingly or make it up at a future date, whichever is most convenient to the client.

5. FL’s trainers are governed by the Chartered Institute for the Management of Sport and Physical Activity (CIMPSPA) and as such will deliver their sessions and advice to the best of their ability in accordance with CIMPSPA’s code of conduct.

The client’s responsibilities to FL

1. Disclosure of information

The client must disclose all health information as requested at the initial consultation and keep the trainer updated and informed of any changes to health status. This includes all medical conditions; physical and mental, injuries, allergies, and medication being taken. If necessary, the client may need to seek clearance from a doctor before participation in the exercise programme the trainer recommends.

2. Accepting potential risks and limitation of liability

Whilst for most people exercise is hugely positive with many health benefits, there remains some risk that the trainer requires the client to be aware of, therefore the client or legal guardian of the client must sign the informed consent and disclaimer that the trainer will provide in person or online prior to the start of the first session.

Fitscape excludes all liability for death, injury or damage caused by the client carrying out exercises incorrectly and against guidance or supervision from the trainer. The client agrees not to bring any claims of whatsoever nature against either FL or any of its trainers in connection with any training or advice provided.

3. If the client cancels or runs late

  • If the client cancels the session(s) with less than 24 hours’ notice or fail to show the client will will incur a full payment of the session fee at the trainer’s discretion.

  • If the client cancels the session(s) with notice between 24 and 48 hours, then the client will incur a 50% payment of the session fee.

  • If the client is late to a session, the trainer will do their best to get the most out of the remaining time left in the session as the trainer is unable to run over time due to previously arranged client commitments.

4. Other terms

5. Payment options

Payment can be made via one of the following options:

  • Cash or cheque at the start of, or before each session/package

  • Direct credit per session no later than the day of training

  • Monthly standing order (for purchased packages)

    • The standing order for a package must clear the bank on the before the first session and then 30 days thereafter on a rolling basis unless the package is cancelled by the client. The package cannot be cancelled during the initial term (1 month).

All monies paid are non-refundable.

6. Being prepared for a session

To get the most out of session the trainer recommends the following:

  • Have a small snack or light meal two or three hours before your session.

  • Are well hydrated and avoid alcohol prior to training.

  • If feeling unwell before your session, please contact your trainer as soon as possible.

  • Bring a small towel and water bottle to each session.

  • Wear appropriate clothing and footwear (ask the trainer if you are unsure)

  • Be ready at the appointed time.

7. Communication and Commitment

While the trainer can give you the tools and encouragement to reach your goals, ultimately the client will need to assume responsibility for making the required changes. The trainer can best help the client with this process if you keep the trainer fully informed of any issues that arise. If the client has any questions or concerns whatsoever please do not hesitate to voice them with the trainer.

Terms of this agreement:

The client understands that they are paying the trainer for their services as outlined in this agreement. If the client does not use the services, the client will still be responsible to make payment for sessions as agreed above. The client agrees to make all payments by the due date.

ACKNOWLEDGEMENT OF THIS AGREEMENT – By continuing the purchase of this service/services the client has read and understood this agreement. A copy will be sent to the client within 7 days.
